1. Introduction
These Terms and Conditions govern your use of the Brookhuis Cleanroom Risk Engine (the "Service"), operated by Brookhuis Applied Technologies ("we", "us", "our"), located at Twentepoort West 17, 7609 RD Almelo, The Netherlands.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
2. Description of Service
The Brookhuis Cleanroom Risk Engine is a web-based calculation tool that helps professionals assess contamination risk for products manufactured in cleanroom environments. The Service provides particle deposition rate calculations, ISO classification recommendations, and monitoring alarm limits based on ISO 14644 standards.
3. Accounts and registration
Certain features of the Service require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate and complete information when creating your account and to keep this information up to date.
4. Free and paid features
The Service offers both free and paid features. Free features include the Quick Scan tool and basic calculation results. The full calculator with detailed analysis, PDF reports, and monitoring setup requires a paid subscription (the "Pro" plan).
5. Subscriptions and payment
Pro subscriptions are billed annually at the price displayed on our pricing page. All payments are processed by our payment provider, Paddle (Paddle.com Market Ltd), which acts as the Merchant of Record for all transactions.
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage your subscription through the billing portal accessible from your dashboard.
All prices are displayed inclusive of applicable taxes, which are calculated and collected by Paddle based on your location.
6. Cancellation
You may cancel your subscription at any time through the billing portal. Upon cancellation, you will retain access to Pro features until the end of your current billing period. After that, your account will revert to the free tier.
7. Refund policy
Refund requests are handled by Paddle in accordance with Paddle's Buyer Terms. You may request a refund within 14 days of your purchase or most recent renewal date. When you cancel your subscription, you will continue to have access to Pro features until the end of your paid billing period. Please see our Refund Policy for full details.
8. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its systems
- Use automated tools to scrape, copy, or extract data from the Service
- Share your account credentials with third parties
- Resell or redistribute the Service or its output without our written consent
9. Intellectual property
The Service, including its design, calculations, methodology, and content, is the property of Brookhuis Applied Technologies and is protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes.
10. Disclaimer and limitation of liability
The calculation results provided by the Service are intended as professional guidance tools based on ISO 14644 standards. They do not replace professional judgment, on-site measurements, or formal cleanroom validation processes.
The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that calculation results will be suitable for any specific application.
To the maximum extent permitted by law, Brookhuis Applied Technologies shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
11. Data protection
We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR).
12. Changes to these terms
We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of The Netherlands. Any disputes arising from these Terms shall be submitted to the competent court in Almelo, The Netherlands.
